A final and binding contract has been concluded between you and Furnmill.com when your order has been confirmed by Furnmill.com

Furnmill.com will send an order confirmation to you by email when the order has been confirmed and shipped. The order receipt received immediately after placing the order does not constitute an order confirmation.

All prices are stated inclusive of GST and other taxes. The applicable price is the one stated on the product page for the relevant product on the date of placing the order. Furnmill.com reserves the right to amend any prices incorrectly stated on this website without prior notice. Furthermore, Furnmill.com reserves the right to amend any prices, taxes, and/or other costs stated on this website at any time, e.g. due to changes in tax rates or other public charges, increased costs, or as a result of the general development in retail prices.

Furnnmill accepts the following credit cards: Visa, MasterCard, and Maestro, and American Express (Through Razor PayPayment gateway). There is no surcharge for using your credit card to make purchases. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order. Your receipt of an electronic or another form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of Furnmill’s offer to sell. Furnmill reserves the right at any time after receipt of your order to accept or decline your order for any reason or to supply less than the quantity you ordered of any item. We will ship your order as it becomes available. However, there may be times when a product you have ordered is out-of-stock, which will delay fulfilling your order. Furnmill will keep you informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment. Furnmill cannot guarantee when an order will arrive. Consider any shipping or transit time offered to you by us only as an estimate. Fulfillment mistakes that Furnmill makes resulting in the shipment of incorrect product to you will also be accepted for return seven (7) days from the date of delivery of the product.

We ensure the information on the site is completely accurate and current. Despite our efforts, however, information on site may occasionally be inaccurate, incomplete, or out of date. We do our best to ensure that the Products supplied correspond as closely as possible to the samples in our stores, website, and catalog. All specifications, product descriptions, prices of the products, and services on the site are subject to change at any time without notice. We make all reasonable efforts to accurately display the attributes of our products and services, including the applicable colors, finishes, and textures. However, the actual colors that you see will depend on the display of your device and we can not guarantee that your device will accurately display such colors, finishes, and textures. Due to unique and characteristic variations of natural materials. We are not responsible for any such variations, which add to the unique quality of the Product, including but not limited to the following:

• Several of our Products are exclusively hand-finished, and Product color and shade may vary from one manufacturing batch to another. This will be more apparent if orders are placed at different times.
• All Product measurements are approximate.
• We reserve the right to make any changes to the Product specifications (external and/or internal) and any other changes where necessary, without prior notice.
• Please check the details of the products shown on the website before ordering, as these products may vary from the Products shown in our catalog, or stores.
• Product specifications will vary from range to range as reflected in the design and price, however, all our Products are manufactured to the same high-quality standards.

We do not warrant the accuracy or completeness of the information, content, or materials through the site. The inclusion of any product or service will be available at any time. We reserve the right to discontinue any product at any time.

Delivery & Shipping

All merchandise ordered on Furnmill.com can be shipped with an approximate shipping time of 7-10 business days. We are unable to process any orders on Sundays and public holidays.

Our delivery partners will attempt to complete your delivery thrice before the item is returned to our warehouse. Please ensure that you provide a valid mobile number and shipping address while placing your order.

Due to varying item availability, orders containing multiple items may sometimes be shipped separately. Each shipment will have its tracking number, which can be tracked on the Track Order page under the same order number.

Returns & Exchanges

We carefully inspect each item before shipment. Should you discover a defect in your furniture, please contact us immediately within 3 days of receiving the package. Furniture that is refused because it does not fit through an entryway will be the customer’s responsibility as we encourage you to study the sizes mentioned on the product page carefully and see if the furniture you order fits into your entryway and rooms.

Once we have delivered the product and left for the customer's premises, we will NOT be able to accommodate any cancellation or change requests. We advise the customer to personally be present during delivery to ensure that they check the furniture at the time of delivery.

Note: There may be errors in the prices, descriptions, or images of certain merchandise, and we reserve the right to restrict orders of those items. In case of a replacement offered, the order or product will be replaced with the originally ordered item and cannot be changed against a variation in the current order (example Upholstery, Wood Finish, or any customization), new order, or a different product.

All exchange & replacement process initiation shall be subject to pick up of all canceled items from your/customer's premises.

The customer shall reserve the packaging material including cartons, bubble wraps, covers, etc. for ease in sending back the furniture with proper packaging.

RISK OF LOSS

The risk of loss and title to products purchased on the Site pass to the purchaser upon delivery to the carrier. The risk of loss and title of Gift Cards and e–Gift Cards passes to the purchaser upon our electronic transmission to the recipient or delivery to the carrier, whichever is applicable.

Comments/Feedback & Other Submissions

If at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party’s intellectual property or these Terms of Service. PRODUCT WARRANTY

Furnmill Furniture comes with a 12-month warranty if properly stored, handled, assembled, maintained, and used under normal conditions in a non-commercial setting. The limited warranty does not apply to:

• Small cuts, scratches, or damage during the cleaning process
• Cracks during the random displacement
• The product kept in contact to direct sunlight and water, resulting in the decaying of wood
• Defects caused by improper product storage, handling, assembly, maintenance, or use normal product wear and tear due to age including wearing or staining, or loosening of fabric or leatherette or any such material.
• With time solid woods are encountered by minor cracks, called checks, which are not included in faults and warranty as these checks do not hamper the life of a product.
• As per the industry standards, unevenness up to 5 mm can happen because of the difference in surfaces and floor levels. In that case, there is no warranty.
• There is no warranty on upholstery/ coverings/ buttons.

No cash refund is available and in no case shall we be liable for more than the purchase price of the furniture or incidental or consequential damages. For warranty issues, we will repair or provide reasonably equivalent furniture as a replacement due to any product defects. Visible defects and variance to order details must be brought to our attention within 3 days of delivery. Issues not presented within 3 days of delivery will be considered “unacceptable” and will not be warranted.

JURISDICTIONAL ISSUES

The Terms and all transactions entered and the relationship between You and Furnmill and any mutual claims shall be governed by the laws of India without reference to any conflict of laws principles. All claims, differences, and disputes arising under or in connection with or in relation thereto the Website, the Terms, or any transactions entered into on or through the Website shall be subject to the exclusive jurisdiction of the courts at Jaipur, Rajasthan India, and you hereby accede to and accept the jurisdiction of such courts.

LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES SHALL FURNMILL OR ANY OF ITS RESPECTIVE EMPLOYEES, DIRECTORS, OFFICERS, AGENTS, VENDORS, OR SUPPLIERS ARE LIABLE FOR ANY DIRECT OR INDIRECT LOSSES OR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE SITE. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL LOSSES AND DAMAGES OF ANY KIND (WHETHER GENERAL, SPECIAL, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, LOSS OF DATA, INCOME, OR PROFITS), WHETHER IN CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, EVEN IF AN AUTHORIZED REPRESENTATIVE OF FURNMILL HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU ARE DISSATISFIED WITH THE SITE OR ANY CONTENT ON THE SITE, OR WITH THESE TERMS & CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE. YOU ACKNOWLEDGE, BY YOUR USE OF THE SITE, THAT YOUR USE OF THE SITE IS AT YOUR SOLE RISK. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OF LIABILITY SET FORTH ABOVE, SO THIS LIMITATION OF LIABILITY MAY NOT APPLY TO YOU.

INDEMNIFICATION AND DEFENSE OF FURNMILL

As a condition of the use of the Site, you agree to defend, indemnify and hold harmless; Furnmill and its respective employees, directors, officers, agents, vendors and suppliers from and against any liabilities, losses, investigations or inquiries, claims, suits, damages, costs, and expenses (including without limitation, reasonable attorneys’ fees and expenses) (each, a “Claim”) arising out of or otherwise relating to your use of the Site.

Third-Party Information

All information concerning third parties is provided solely for your reference. Furnmill is not endorsing the Third Party Information and is not responsible for any errors and representation nor is it associated with it and you shall access the Third Party Information at your own risk. Further, it is up to you to take sufficient precautions to ensure that whatever links you select, whether from the Platforms, or other Services, is free of such items such as, but not limited to, viruses, worms, Trojan horses, defects, and other items of a destructive nature

Intellectual Property Rights

All the intellectual property used on the Platforms by Furnmill shall remain the property of Furnmill, its parent company, group companies, subsidiaries, associates, affiliates, suppliers, vendors, sister companies, or of any third party hosting such intellectual property on the Platforms. Except as provided in the Terms of Use, the materials may not be modified, copied, reproduced, distributed, republished, downloaded, displayed, sold, compiled, posted, or transmitted in any form by any means, including but not limited to, electronic, mechanical, photocopying, recording or other means, without the prior express written permission of Furnmill, its parent company, group companies, subsidiaries, associates, affiliates, suppliers, vendors, sister companies or any third party hosting such material on the Platforms, as the case may be. MISCELLANEOUS

These Terms & Conditions, including policies incorporated herein, constitute the entire agreement between you and Furnmil concerning the Site. These Terms & Conditions supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Furnmill concerning the Site. No provision of these Terms & Conditions shall be waived except according to a writing executed by the party against whom the waiver is sought. No waiver will be applicable other than in the specific instance in which it is given. No failure to exercise, partial exercise of, or delay in exercising any right or remedy, or failure to require the satisfaction of any condition under, these Terms & Conditions shall operate as a waiver or estoppel of any right, remedy, or condition. If any provision of these Terms & Conditions is held invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions will not be affected or impaired. Nothing in these Terms & Conditions creates a relationship of agent and principal, partners, joint venturers, or employer-employee between the parties, and no act or obligation of either party will in any way bind the other. You may not assign, transfer or sublicense any or all of your rights or obligations under these Terms & Conditions without our express prior written consent. IMPORTANT

The responsibility of our logistics partners to deliver the furniture is restricted to the ground floor. Also, our delivery personnel is not equipped to remove doors and windows to affect access or even open the crates. If doors, windows, or stair banisters need to be removed in order for the furniture to fit, you will need to arrange this on your own.
To ensure, easy entry of furniture, please refer to the Measure For Delivery.

Delivery and shipping

1. Please note that our shipping partner delivers till ground floor only.
2. All merchandise ordered on Furnmill.com can be shipped with an approximate shipping time of 10 to 15 business days.
3. Out of Diameter(OD) Charges are applicable to certain pin codes where our shipping partner charges an extra fee. Please note, that our store bears the base charge, OD Charge is an additional fee that is location specific. You can check for the same by entering pincode in pincode checker
